Terms and conditions

1. Allgemeines
Der Liebherr Hausgeräte-Shop (nachfolgend kurz „Online-Shop“ genannt) wird von der Liebherr-Hausgeräte Ochsenhausen GmbH, Memminger Straße 77-79, 88416 Ochsenhausen, [email protected] (nachfolgend kurz „Liebherr“ genannt) betrieben, die Verkäuferin der angebotenen Produkte ist.Bestellungen und Aufträge des Kunden und Lieferungen an den Kunden über Produkte aus dem Online-Shop werden ausschließlich zu den vorliegenden Allgemeinen Liefer- und Zahlungsbedingungen (nachfolgend kurz „LZB“ genannt) ausgeführt. 

Bestellungen im Online-Shop dürfen ausschließlich von Verbrauchern i. S. d. § 13 BGB, soweit diese das 18. Lebensjahr vollendet haben, abgegeben werden.

2. Vertragsschluss
Die Präsentation der Produkte im Online-Shop ist noch kein Angebot auf Abschluss eines Kaufvertrags. Der Kunde gibt mit Abgabe seiner Bestellung durch einfachen „Klick“ auf die Schaltfläche „Jetzt kostenpflichtig bestellen“ ein verbindliches Angebot an Liebherr zum Abschluss eines Vertrags ab. Der Kunde erhält unverzüglich eine Bestellbestätigung per Email. Diese Bestellbestätigung bestätigt den Eingang der Bestellung des Kunden bei Liebherr und führt die Einzelheiten der Bestellung, wie z.B. die bestellten Produkte, Preise, Versand und weitere Einzelheiten auf. Sie stellt keine Annahme des vom Kunden abgegebenen Angebotes dar. Ein Kaufvertrag kommt erst dann zustande, wenn Liebherr dem Kunden den Versand oder den Auftrag der Produkte in einer weiteren Nachricht bestätigt (Versandbestätigung oder Auftragsbestätigung).

3. Lieferung
Der Versand von Produkten ist nur innerhalb der Bundesrepublik Deutschland möglich.

Die Lieferzeit der für Zubehör-Produkte beträgt zwei bis vier Werktage ab Vertragsschluss. Die Lieferung von individualisierten Geräten erfolgt innerhalb von 25 bis 35 Werktagen ab Vertragsschluss.

Im Falle von höherer Gewalt tritt eine angemessene Verlängerung der Lieferzeiten ein. Dauert die die Lieferverzögerung länger als vier Wochen an, ist jeder Vertragspartner zum Rücktritt berechtigt.

4. Preise/Gefahrübergang
Alle angegebenen Preise verstehen sich inklusive gesetzlicher Mehrwertsteuer zuzüglich der jeweiligen Versandkosten.

Die Gefahr geht mit Übergabe der Produkte auf den Kunden über.

5. Zahlungsbedingungen/Eigentumsvorbehalt
Kunden können den Kaufpreis per Kreditkarte, per Sofortüberweisung oder mit PayPal begleichen. Bei Zahlung mit Kreditkarte erfolgt die Belastung des Kaufpreises mit Versand der Bestellbestätigung. Versand- und Rechnungsadresse müssen im Bundesgebiet von Deutschland liegen.

Die Produkte bleiben bis zur vollständigen Bezahlung im Eigentum von Liebherr.

6. Gewährleistung/Haftung
Die Mängelansprüche des Kunden für Rechts- und Sachmängel richten sich nach den gesetzlichen Bestimmungen.

Soweit die Schadensursache auf einer vorsätzlichen oder grob fahrlässigen Pflichtverletzung von Liebherr oder einem gesetzlichen Vertreter oder Erfüllungsgehilfen von Liebherr beruht, haftet Liebherr unbeschränkt. Ferner haftet Liebherr für die leicht fahrlässige Verletzung von wesentlichen Pflichten nur für den voraussehbaren, vertragstypischen Schaden. Wesentlich sind Pflichten, deren Verletzung die Erreichung des Vertragszwecks gefährdet oder deren Erfüllung die ordnungsgemäße Durchführung des Vertrages überhaupt erst ermöglicht und auf deren Einhaltung der Kunde regelmäßig vertraut. Liebherr haftet nicht für die leicht fahrlässige Verletzung anderer als der in den vorstehenden Sätzen genannten Pflichten. Die vorstehenden Haftungsbeschränkungen gelten nicht bei Verletzung von Leben, Körper und Gesundheit, für einen Mangel nach Übernahme einer Garantie für die Beschaffenheit der Produkte und bei arglistig verschwiegenen Mängeln. Die Haftung nach dem Produkthaftungsgesetz bleibt unberührt. Soweit die Haftung von Liebherr ausgeschlossen oder beschränkt ist, gilt dies auch für die persönliche Haftung von Arbeitnehmern, Vertretern und Erfüllungsgehilfen. 

7. Besondere Bedingungen – Produktkonfigurator
Wurde das Produkt von Liebherr aufgrund von Zeichnungen, Bildern oder sonstigen Vorgaben des Kunden angefertigt, erstreckt sich die Haftung von Liebherr nur darauf, dass die Ausführung entsprechend den Vorgaben des Kunden erfolgt ist.

Der Verbraucher sichert ausdrücklich zu, dass er über sämtliche erforderlichen Rechte zur Nutzung, Weitergabe, Vervielfältigung, Bearbeitung und Verarbeitung der bereitgestellten Zeichnungen, Bilder und sonstigen Vorgaben verfügt und dass daher durch Liebherr keinerlei wie auch immer gearteten Rechte Dritter verletzt werden. Ferner sichert der Kunde ausdrücklich zu, dass die von ihm bereitgestellten Zeichnungen, Bilder und sonstige Vorgaben keinerlei rechtswidrige oder pornographische Inhalte aufweisen. Sollte Liebherr berechtigte Zweifel an der Richtigkeit der genannten Zusicherungen haben, ist Liebherr jederzeit berechtigt vom Vertrag zurückzutreten. 

Sofern Liebherr bei Fertigung und Lieferung nach den vom Verbraucher bereitgestellten Zeichnungen, Bildern und sonstigen Vorgaben von Dritten in Anspruch genommen wird, wird der Kunde Liebherr von sämtlichen Ansprüchen sowie sämtlich daraus resultierenden Nachteilen vollständig freistellen. 

7. Anwendbares Recht
Es gilt das Recht der Bundesrepublik Deutschland unter Ausschluss des UN-Kaufrechts. 

8. Alternative Streitbeilegung
Unter http://ec.europa.eu/consumers/odr/ stellt die Europäische Kommission eine Plattform zur Online-Streitbeilegung zur Verfügung. Liebherr ist zur Teilnahme an einem Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle nicht verpflichtet und nicht bereit.

These Conditions of Purchase are the terms on which we will supply products to you when you purchase goods from us through our website. Please read them carefully as they contain important information, including information about your rights.

By law, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, say that we must give you certain key information before a legally binding contract between you and us is made (see below). We will give you this information in a clear and understandable way.

The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 say that up to 14 days after receiving your goods, in most cases, you can change your mind and get a full refund.

1 General

1.1         In these Conditions of Purchase:

(a)          ‘we’, ‘us’ or ‘our’ means Liebherr-Great Britain Limited (a limited company registered in England and Wales with number 00677497); and

(b)          ‘you’ or ‘your’ means the person using our website to buy products from us.

2 Introduction

2.1         These Conditions of Purchase govern the purchase of products by you from us. If you buy products on our website you agree to be legally bound by these Conditions of Purchase. You may only buy products from our website for non-business reasons.

2.2         This contract is only available in English. No other languages will apply to these Conditions of Purchase. We will always communicate with you in English.

2.3         When buying any products you also agree to be legally bound by:

(a)          our website terms of use and any documents referred to in them; and

(b)          any specific terms which may apply (in addition to these Conditions of Purchase) to certain products (for example, MyStyle products and spare parts). If you want to see these specific terms, click on the Terms and Conditions link at any time during the online purchase or checkout process.

3 Your privacy and personal information

3.1         Your privacy and personal information are important to us. Any personal information that you provide to us will be dealt with in line with our Privacy Policy, which explains what personal information we collect from you, how and why we collect, store, use and share such information, your rights in relation to your personal information and how to contact us and supervisory authorities if you have a query or complaint about the use of your personal information.

4 Ordering products from us

4.1         Below, we set out how a legally binding contract between you and us is made. Please note, by showing products on our website that you are able to purchase from us, this is not an offer by us to make a contract with you in respect of such products.

4.2         You place an order on our website by clicking on the ORDER WITH AN OBLIGATION TO PAY button. Please read and check your order carefully before submitting it. However, if you need to correct any errors you can do so before submitting it to us.

(a)          When you place your order at the end of the online checkout process (e.g. when you click on the ORDER WITH AN OBLIGATION TO PAY button, we will acknowledge it by email. This acknowledgment does not, however, mean that your order has been accepted by us.

(b)          We may contact you to say that we do not accept your order. This is typically for one or more of the following reasons:

(i)            the goods are unavailable;

(ii)           we cannot authorise your payment; (in which case your credit card or debit card will not have been charged);

(iii)          you are not allowed to buy the goods from us;

(iv)          we are not allowed to sell the goods to you;

(v)           you have ordered too many goods;

(vi)          there has been a mistake on the pricing or description of the goods; or

(vii)         your personalised goods are not in accordance with our personalisation guidelines (if you want to see our personalisation guidelines click at the guideline link for personalised goods at any time during the online purchase process).

If we do not accept your order for any of the reasons set out above (other than where we cannot authorise your payment) we will refund you as soon as possible and in the event within 14 days.

(c)           We will only accept your order when:

(i)            we email you to confirm this; or

(ii)           we email you to confirm that your order has been dispatched (Shipping Confirmation Email).

Once we have sent you a Confirmation Email a legally binding contract will be in place between you and us and we will dispatch the products to you.

4.3         If you are under the age of 18 you may not buy any products from our website.

 

5 Right to cancel this contract

5.1         You have the right to cancel your contract with us within 14 days without giving any reason.

5.2         The cancellation period will expire 14 days after the day on which you receive your products.

5.3         To exercise the right to cancel, you must inform us of your decision to cancel your contract by a clear statement (e.g. a letter sent by post, fax or email). You may use the model cancellation form set out in the box below, but it is not obligatory. When informing us of your decision to cancel it would also be helpful if you quote the Order Number.

.4         To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired.

5.5         There is no right to cancel contracts for the supply of products made by us to your specifications or clearly personalised once an order for such products has been accepted by us. Such products are clearly designated on our website and cannot be cancelled without incurring certain cancellation and/or restocking charges. We will set these charges on a "per order" basis which will be proportionate to reflect the loss we will reasonably incur, dependent upon your specification or personalised product. We will tell you what cancellation charges may be payable.

 

6 Effects of cancellation

6.1         If you cancel your contract, we will reimburse to you all payments received from you, including the costs of delivery.

6.2         We may make a deduction from the reimbursement set out at clause 6.1 in respect of any loss in value of any products supplied, if the loss is the result of unnecessary handling by you.

6.3         We will make the reimbursement without undue delay, and not later than:

(a)          14 days after the day we received back from you any products supplied; or

(b)          (if earlier) 14 days after the day you provide evidence that you have returned the products; or

(c)           if there were no products supplied, 14 days after the day on which we are informed about your decision to cancel this contract.

6.4         We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise. In any event, you will not incur any fees as a result of the reimbursement.

6.5         If you have received products:

(a)          you shall send back the products or hand them over to us without undue delay and in any event not later than 14 days from the day on which you communicate your cancellation from this contract to us. The deadline is met if you send back the products before the period of 14 days has expired;

(b)          you will have to bear the direct cost of returning the products. The cost for parts and accessories is estimated at a maximum of approximately £7.00. The cost for appliances is estimated at a maximum of approximately £50.00. 

(c)           Goods should be returned in their original packaging and in the same condition in which they were sold; and

(d)          you are only liable for any diminished value of the products resulting from your use and handling of the products other than what is necessary to establish the nature, characteristics and functioning of the products.

6.6         The provisions of this clause 6 are subject to clause 5.5.

7 Delivery

7.1         We use TNT, DHL, The Appliance Company , or a similar delivery contractor, to deliver our products. If you want to see your delivery options, visit our Shipping Costs and Delivery link before you place your order.

7.2         The estimated date window for delivery of the products is set out in the Confirmation Email.

7.3         We will deliver the products to you as soon as is reasonably possible and in any event within 30 days after the day we send the Order Confirmation Email. However, we aim to deliver parts and accessories within 2 to 4 days of this. We aim to deliver appliances within 2 weeks of the order confirmation. Personalised products are subject to a longer delivery time due to the personalised nature of the products. We aim to deliver personalised products within 14-16 weeks after the Order Confirmation Email. Unless otherwise stated on our website, delivery estimates shall be only an estimated time of delivery. They are not guaranteed delivery times and should not be relied upon as such and we are not liable if products are delivered later than the estimated delivery date. If something happens which:

(a)          is outside of our control; and

(b)          affects the estimated date of delivery;

we will let you have a revised estimated date for delivery of the products.

7.4         If we cannot deliver your products within the period mentioned in clause 7.3 of the date which we sent the Order Confirmation Email (either as a result of something outside of our control or otherwise):

(a)          we will let you know of the delay;

(b)          you can cancel your order and we will give you a refund; or

(c)           you can give us a new deadline for delivery, and if we don’t meet the revised deadline, you can treat the contract as at an end and get a refund.

For personalised products only clause 7.4. lit. (a) will apply.

7.5         Delivery of the products will take place when we deliver them to the address that you gave to us. You should ensure that you have all necessary assistance in place in order to receive delivery of the products and storing the products at your property.

7.6         If nobody is available to take delivery, please contact us using the contact details set out in this contract to rearrange.

7.7         Upon delivery, we suggest that you perform a short visual inspection to check all expected items have been delivered. We also suggest you check the delivery note. If any products delivered are damaged, incomplete or faulty, we recommend that you inform us within 48 hours of the products being delivered to you so that we can process your return.

7.8         You are responsible for the products when the delivery has taken place. In other words, the risk in the products passes to you when you take possession of the products.

7.9         We only deliver appliances to mainland Great Britain. We only deliver parts and accessories to Great Britain, excluding Jersey, Guernsey and the Isle of Man.

7.10       All deliveries and delivery costs and offers relate to standard delivery only. For appliances, standard delivery includes the ground floor room of choice. For any non-standard delivery requirements, we may carry out a site survey and additional charges may apply. You should make us aware of any non-standard delivery requirements as soon as possible by emailing [email protected].

(a)    In the event of a refund a delivery fee will be charged or deducted from the refund provided if the delivery of the appliance is cancelled based on the following statements.

i.                 Customer failed to provide accurate delivery information, including but not limited to incorrect height of doors or access to property.

ii.                Customer did not provide details on parking restrictions and/or accurate information for the delivery team to carry out the delivery safely.

iii.               Customer failed to provide safe access to the property.

iv.               Customer failed to provide accurate information on how narrow and/ or how many steps there are to get to the room of choice.

v.                The customer cancelled the delivery of their appliance on the day of delivery.

vi.               The customer refuses delivery at the door, for reasons not covered in our terms and conditions.

 

8 Payment

8.1         Payment shall be transacted through the Unzer E-com GmbH gateway. We accept most credit cards and debit cards, and PayPal. We do not accept cash.

8.2         Your credit card or debit card, or PayPal account will be charged at checkout.

8.3         All payments by credit card or debit card need to be authorised by the relevant card issuer or by PayPal. We may also need to use extra security steps via:

(a)          Verified by Visa: https://www.visa.co.uk/pay-with-visa/featured-technologies/verified-by-visa.html;

(b)          Mastercard®SecureCodeTM: https://www.mastercard.co.uk/en-gb/consumers/features-benefits/securecode.html;

(c)          PayPal PSD2 2 factor authentication: https://www.paypal.com/uk/smarthelp/article/what-are-the-payment-services-directives-and-strong-customer-authentication-faq4202?app=searchAutoComplete

8.4         If we cannot supply you with the products that you ordered but you have already paid for them we will refund you as soon as possible and in any event within 14 days.

8.5         Nothing in this clause affects your legal rights to cancel the contract during the ‘cooling off’ period under clauses 5 and 6.

8.6         The price of the products:

(a)          is in pounds sterling (£)(GBP);

(b)          includes VAT at the applicable rate; and

(c)           excludes the shipping cost of the products, which will be specified at Checkout

8.7         There always remains a chance that the products we provide may be mispriced on our website. We will check the price of products when we process your order and before we take payment from you.

8.8         If the actual price of the products is found to be higher than the price stated on our website at the time we process your order, we may either:

(i)            contact you before the products are dispatched and ask whether you wish to buy the products at the correct price; or

(ii)           cancel your order; or

8.9         If the actual price of the products is found to be lower than the price on our website at the time we process your order, we will take payment from you at the lower price.

8.10       The products shall remain our property until we have received payment in full from you.

 

9 Nature of the products

9.1         The Consumer Rights Act 2015 gives you certain legal rights (also known as ‘statutory rights’), see a summary of your rights set out at the start of these Conditions for Purchase. We must provide you with products that comply with your legal rights.

9.2         The packaging of the products may be different from that shown on our website.

9.3         While we try to make sure that:

(a)          the colours of our products are displayed accurately on our website, the actual colours that you see on your computer may vary depending on the monitor that you use.

9.4         When you order products on our website, we will let you know the availability of such products. When we process your order and any products you have ordered are no longer available, we will let you know and you will be refunded for all costs

9. 5        Liebherr SmartMonitoring products are not intended for domestic use. In order to use Liebherr SmartMonitoring products, you must be aged 18 or over, and are required to have a Liebherr account. For full details of SmartMonitoring please see https://smartmonitoring.liebherr.com

 

10 Faulty products

10.1       If the products provided to you are faulty, mis-described or not of satisfactory quality, you may have a legal right to get the product repaired or replaced, or reject the product and get some or all of your money back.

10.2       If you have any questions or complaints about the product, please contact us using the contact details set out in these Conditions of Purchase.

10.3       Nothing in this contract affects your legal rights under the Consumer Rights Act 2015. You may also have other rights in law.

 

11 Returns

11.1       Where the products are returned because they are faulty, mis-described or not of satisfactory quality, we will pay for the costs of the return of the goods. However you must arrange for their return or make them available for us to collect them from you.

 

12 End of the contract

If your contract with us is ended it will not affect our right to receive any money which you owe to us under such contract.

 

13 Limit on our responsibility to you

13.1       We do not exclude or limit our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for breach of your legal rights (including the right to receive the products as described and which are of satisfactory quality); or arising under applicable laws relating to the protection of your personal information, we are not legally responsible for:

(a)          losses that:

(i)            were not foreseeable to you and us when the contract was formed; or

(ii)           that were not caused by any breach on our part;

(b)          business losses; and

(c)           losses to non-consumers.

 

14 Amendments to the Conditions of Purchase

14.1       We may amend these Conditions of Purchase at any time, for one or more of the following reasons:

(a)          to respond proportionately changes in any relevant laws or regulation; or

(b)          to make them easier to understand or fairer to you;

we will inform you of any changes as soon as possible.

14.2       Any order placed by you for products will be subject to the Conditions of Purchase in force at the time you place your order.

 

15 Waiver

If we fail to or delay to take any action that we are entitled to take as a result of a breach of the terms of these Conditions of Purchase by you, we will still be entitled to take such action in respect of any other breaches you may commit.

 

16 Severability

If any term of these Conditions of Purchase is deemed illegal, invalid or unenforceable, such terms shall be severable and this will not affect the validity or enforceability of any other term in these Conditions of Purchase.

 

17 Third party rights

17.1 No one other than you or us has any right to enforce any term of the contract between you and us.

 

18 Disputes and Governing Law

18.1       We will try to resolve any disputes with you quickly and efficiently.

18.2       If you are unhappy with the products or any other matter, please contact us as soon as possible.

18.3       If you want to take court proceedings, the courts of the part of the United Kingdom in which you live will have non-exclusive jurisdiction in relation to this contract.

18.4       The laws of England and Wales will apply to this contract.

20 MyStyle colour match guarantee

20.1 Only single-colour appliances are eligible for this offer. The same colour must be applied on all sides and doors of the appliance. 

20.2 Appliances must be rejected at the point of delivery and must be unused, not plugged in, and with all original packaging. As soon as our delivery partner leaves the delivery property, this offer is no longer applicable.

20.3 This offer is only applicable where the colour does not match the expectation given in the colour preview page. Liebherr will record a screenshot of the colour preview with each order placed. 

20.4 We reserve the right to remove this promotion at any time, without prior notice. Any orders placed between 14th October 2022 and the withdrawal of the offer will remain eligible.

 

21 MyStyle extended guarantee

MyStyle purchases made after 11th July 2022 are available with the choice of a free 5-year guarantee or a half-price 10-year guarantee.

21.1 The guarantee duration must be chosen prior to the appliance being delivered to the customer. If you have not made us aware of your preference before your appliance is delivered, you will be automatically registered for a 5 year guarantee.

21.2  This guarantee is not transferable to any other appliance.

21.3 This guarantee has no cash value and cannot be exchanged for any other products.

21.4 This guarantee is subject to the Liebherr extended guarantee terms and conditions.

21.5 The price of the 10-year guarantee will be 50% discount against the current 10-year guarantee price, given in the form of a voucher code for processing on the Liebherr webshop. The 10-year WarrantyPlus can be purchased at any time during the 2-year standard guarantee period.

21.6 This offer is not available with competition prizes.

21.7 Only one extended guarantee can be applied to each appliance.

21.8 We reserve the right to remove this promotion at any time, without prior notice.

 

22 Free recycling

MyStyle purchases made between 19th July and 31st December 2024 are available with free recycling of your old appliance.

22.1 Only 1 refrigeration appliance will be collected per MyStyle order.

22.2 The appliance being collected must no more than 10% taller, wider, deeper or heavier than the appliance being delivered. The collection appliance can be smaller than the one being delivered.

22.3 Collection must take place at the same time as delivery.
