Personal commonly used device information: information describing the basic situation of personal commonly used devices, including operating system type and unique device identification code (such as IMEI/Android ID/IDFA/OPENUDID/GUID, SIM card IMSI information, etc.), application version, language settings;
  7. Personal location information: location information, longitude and latitude, shipping address, bill address.

Sensitive personal information means the personal information that is likely to result in damage to the personal dignity of any natural person or damage to his or her personal or property safety once disclosed or illegally used, including such information as biometric identification, religious belief, specific identity, medical health, financial account and whereabouts and tracks, as well as the personal information of minors under the age of 14. Sensitive personal information we may collect from you under this Policy includes the following and we shall also obtain your separate consent in the form of Appendix 1.

The above information is the basic information we must collect to process your account registration application and to comply with laws, regulations and regulatory requirements. If you refuse to provide those information (or the information so provided is incomplete, inaccurate or untrue), we may be unable to process your account registration application.

You may choose to provide us with supplementary user information such as your date of birth, interests, preferences, etc. This information is not necessary to the operation of this function, but it is highly important to the improvement of service quality and the research and development of new products or services, etc. We will not force you to provide this information, and your refusal will not have any adverse effect on your use of this function.

    1. How we collect personal information from you

We will collect your personal information when you use our products and/or services (such as online registration or visit, filling out questionnaires, participating in one of our online experiences, participating in offline activities, etc.) including your name, home address, e-mail address, mobile phone number and payment information, etc. We may also collect your personal information from you under other circumstances.
      2. We may automatically collect some information retained by you when visiting our products and/or services, including your Internet Protocol Address (IP), operating system, browser type, and path, date and time of your visit and purchase.

  1. How We Use Cookies and Similar Technologies
  1. Our use of Cookies

We will send one or more small data files named Cookies to your computer or mobile device so that we can recognize the computer or mobile device the next time you log on to the computer or mobile device. Cookies usually contain identifiers, site names, and some numbers and characters. With the help of Cookies, we can manage and improve our systems to store data.

We will not use Cookies for any purpose other than the purposes stated in this Policy. You can manage or delete Cookies in accordance with your preferences. You can clear all Cookies saved on your computer or mobile device. Most web browsers are set to automatically accept cookies, but you can reject Cookies by modifying the browser settings and turning on the blocking Cookies function.   1. Our use of similar technologies

Apart from Cookies, we will also use similar technologies such as embedded Web links. We may call the code of H5, that is, after exposing the global objects (including methods) in H5, call the aforementioned objects to realize direct access to the Web surface by jumping the page. Embedded Web links enable us to publish or update activity pages and text announcements to you in a timely manner.

      1. We may entrust our affiliates or other external suppliers to process your personal information on our behalf. We will sign strict confidentiality agreements with them, requiring them to handle personal information in accordance with our instructions, this Policy and any other relevant confidentiality and security measures (including any mandatory requirements required by applicable law).

Such provision or disclosure will involve cross border transmission of personal information, including information being transmitted to or being accessed from overseas only when the above recipient(s) is an overseas institution/person. Whether it is processed domestically or overseas, in accordance with applicable data protection legislation, your personal information will be protected by a strict code of secrecy and security which, we, other members of the Liebherr Group, their staff and third parties are subject to.   1. How We Keep Your Personal Information
  1. In general, we will keep your personal information for the minimum necessary time. However, there may be circumstances that mean we must keep your personal information for longer or for the time limit mandatorily required under applicable laws and regulations.  For example, if there was an ongoing tribunal, court or another type of proceeding, we would keep your information until the end of those proceedings and any possible appeals, and the end of any relevant claims periods.

We have adopted industry-standard safety protection technical measures such as establishing data security management system ISO 27001, holding security and privacy protection training courses, taking safety protection measures to your personal information in an appropriate manner according to the applicable law, etc., to protect personal information you have provided, and enhanced the safety of personal information from all aspects such as organization construction, system design, personnel management, product technology, etc., in order to protect your personal information from unauthorized access, public disclosure, use, modification, damage or loss.

For the security of your personal information, you take on the same responsibility as us.  You shall properly take care of your personal information, such as your account information (e.g. user name, password, verification code, etc.), and all the documents, devices or other media that may record or otherwise relate to such information, and shall ensure your personal information and relevant documents, devices or other media are used only in a secured environment. You shall not, at any time, disclose to any other person or allow any other person to use such information and relevant documents, devices or other media. Once you think your personal information and/or relevant documents, devices or other media have been disclosed, lost or stolen, or may otherwise affect the security of your use of Liebherr’s data, information or devices, you shall notify us immediately so that we may take appropriate measures to prevent further loss from occurring.
  4. The Internet environment is not completely secure. We will try our best to ensure or guarantee the safety of any information you send us. We will take responsibility in accordance with the law if your information suffers from unauthorised access, public disclosure, erasure or damage for a reason attributable to us and so impairs your lawful rights and interests.
  5. If unfortunately, personal information security incident occurs, we will adopt emergency plan and take relevant actions and remediation measures to mitigate the severity and losses in connection therewith.  We will, following the applicable requirements set out in law and regulation, inform you of the basic information of the security incident and its possible impact, the actions and measures we have taken or will take, suggestions for you to prevent and mitigation the risk, and applicable remediation measures.  We will also inform you of the relevant information of the incident by email, mail, call, SMS, push notification or through other methods as appropriate in a timely manner.  When it is difficult to inform the personal information subjects one by one, we will post public notice in a reasonable and effective way. Meanwhile, we will also report such personal information security incident in accordance with applicable law, regulation and regulatory requirements.
  1. What Rights You Can Exercise to Handle Your Personal Information Collected by Us
  1. In order to fully protect your personal information, we support you to exercise the following rights to your personal information.
  2. Delete your personal information: You can make a request to us through our contact information in this Policy to delete your personal information in the following situations:
  1. If our processing of personal information violates laws and regulations;
  2. If we collect and use your personal information without your consent or you withdraw your consent;
  3. If our processing of personal information violates the agreement with you;
  4. If the purpose of processing has been achieved, it is impossible to achieve such purpose, or it is no longer necessary to achieve such purpose;
  5. If the retention period has expired.

If we decide to respond to your deletion request, we will also notify other entities that obtained your personal information from us to delete it in a timely manner, unless otherwise stipulated by laws and regulations, or these entities obtain your independent authorization.

When you delete relevant information or when we help you to do so, due to the laws applied and safety technology limitation, we may not be able to delete the corresponding information from the backup system timely. We will store your personal information safely and limit any further disposal until backups can be deleted or anonymized.

Change the scope of your authorization: You can change the scope of your authorization to continue collecting personal information or withdraw your authorization by deleting information, turning off device functions, modifying privacy settings and etc. You can also withdraw our authorization to continue collecting your personal information by cancelling your Liebherr system account, except for the personal information specified in Section 2.4.1 to which your authorization or consent is not needed.

Please understand that each business function requires some basic personal information to be completed. When you withdraw your consent or authorization, we or Liebherr system cannot continue to provide you with the functions that require such consent or authorization, nor will we or Liebherr system process your corresponding personal information. However, your decision to withdraw your consent or authorization will not affect the personal information processing previously carried out based on your authorization.

  1. Constrained information system automatic decision making: In some business functions, we may only make decisions based on non-manual automatic decision-making mechanisms including information systems, algorithms, etc. If these decisions significantly affect your legitimate benefits, you have the right to ask us for an explanation and we will also provide appropriate relief.
  2. Response to your above request: To ensure safety, we may need you to provide a written request or prove your identity in other appropriate ways.  We will reply to your request after receiving your feedback on identity authentication and completing the authentication. If you are not satisfied with our reply, you can also seek external resolutions through the methods provided in this Policy.
  3. Under the following circumstances, we will not be able to respond to your request in accordance with laws and regulations:

  1. How Your Personal Information are Transferred around the World
  1. In general, we will store within PRC your personal information generated and collected within PRC. However, we deal with many international organisations and use global information systems. As a result, we may transfer your personal information to countries outside the PRC that have different data protection laws with PRC.  We take steps to make sure that, when we transfer your personal information to another country or region, appropriate protection is in place in line with data protection laws requirements in PRC.

By receiving our services, you are agreeing to your personal information being forwarded or transmitted to our offices or entrusted service providers, including those internationally to Liebherr entities in that country. You further understand and agree that your information may be transmitted, processing and stored out of PRC and to other countries or regions by Liebherr and its entrusted service providers. If information you provided includes personal information of individuals based within or outside PRC, you agree to obtain express consent, whenever required under the applicable law, from these individuals prior to the submission of such personal information to us.  By consenting to this Policy, you confirm that explicit consent has been obtained from the relevant individuals. We will also seek your separate consent in the form of Appendix III.

You can also make a complaint with another supervisory authority which is based in the country or territory where: (1) you live; (2) you work; or (3) the matter you are complaining about took place.

  1. Applicable Law and Dispute Resolution

The interpretation of this Policy and dispute resolution shall be governed by the laws of the PRC. Any dispute arising from this Policy and our handling of your personal information, you agree to submit it to Shanghai Arbitration Commission (“SAC”) for arbitration in accordance with the Arbitration Rules of the SAC (“SAC Rules”) for the time being in force. The arbitration shall be final and legally binding on both parties. The language to be used in the arbitral proceedings shall be English. The Parties undertake to keep the arbitration proceedings and all information, pleadings, documents, evidence and all matters relating thereto confidential.
